Terms of service

These terms of service (the “Terms”) govern access to and use of the Mr Editor website and photo generation service (the “Service”). By creating an account, purchasing credits, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. The service

The Service accepts a photograph submitted by you and generates a listing image from it. The Service is intended for photographs of tabletop objects. One credit is required for each image generated. We may modify or suspend any feature of the Service at any time. Discontinuation of the Service in its entirety is governed by section 9.

2. Eligibility and accounts

You must be at least 18 years old to use the Service. You must register an account to generate images. You agree to provide accurate registration information, to keep your credentials confidential, and to remain responsible for all activity that occurs under your account. We may suspend or terminate an account that we reasonably believe is being used in violation of these Terms.

3. Credits

Credits are a prepaid balance redeemable only within the Service. One credit entitles you to one image generation. Credits have no cash value and are not transferable, refundable, or resaleable. Credits are good for 12 months from purchase. Credit packs, prices, and credit amounts are subject to change, and a purchase does not fix the price of future purchases.

If a generation fails, we will attempt to return the credit to your balance. If a generation completes, the credit is treated as used, whether or not you are satisfied with the result.

4. Payment

Payments are processed by Stripe, Inc. Your use of Stripe’s payment services is subject to Stripe’s own terms. Prices are stated exclusive of applicable taxes, which may be added at checkout. We may suspend access to an account while a chargeback or payment dispute relating to it is unresolved.

5. Your content

You represent that you hold all rights necessary to submit each photograph you upload, and that doing so does not infringe the rights of any third party or violate any law. You retain all rights you hold in the photographs you submit. You grant us a non-exclusive, worldwide licence to store your photographs, transmit them to our service providers, generate images from them, and make the resulting images available to you, in each case for the purpose of providing and supporting the Service.

Generated images are provided for your listings and ordinary business use. Generated images are not a representation or warranty as to the appearance, condition, or characteristics of any physical object.

6. Acceptable use

You may not use the Service to violate any law, to infringe the rights of others, to impersonate any brand or person, to generate sexual content involving minors, or to interfere with the operation or security of the Service. We may decline to process a submission, withhold a generation, or terminate an account in connection with a violation of this section.

7. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that generated images will meet your requirements, or that use of the Service will result in any sale.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or relating to the Service. Our aggregate liability arising out of or relating to the Service will not exceed the amount you paid us in the thirty days preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

9. Termination and discontinuation

You may stop using the Service at any time. We may suspend or terminate your access to the Service in accordance with these Terms.

We may discontinue the Service. If we discontinue the Service in its entirety, we will give at least 30 days’ notice to the email address on your account. You may use your remaining credits during that period, and we will refund the purchase price of any credits that remain unused at the end of it.

Sections that by their nature should survive termination will survive, including sections 3, 5, 7, 8, and 10.

10. Changes to these terms

We may revise these Terms from time to time. The version posted on this page is the version that applies. Your continued use of the Service after a revision takes effect constitutes acceptance of the revised Terms.
